Careless Wisper or not?

The Careless wispers are going to go into production as soon as I get permission for a food business from the council. In the meantime I am busy creating the brand and some packaging. I need help! Namely what do I put on the packaging? If I call them Careless Wisper is a certain chocolate company going to sue me?

I believe I am able to continue these and if Cadburys have an objection, they need to contact me and ask that I stop it. I would then have to change the name/branding. Only if I fail to stop could they then take me to court. I’m happy to continue plan A and wait for a letter to come through the door. If this is indeed how it works.

Hence option number two is to call them something different. Luxury filled chocolate bar doesn’t quite slip off the tongue. Any suggestions would be grateful!


The line up, l-r. Caramelised pineapple and toasted coconut. Chocolate caramel and dark chocolate ganache. Orange and star anise. The original. Salted caramel, dark chocolate mousse and a secret ingredient!

      Thanks Alison. Someone has sent me the legalities of it all and it’s quite simple I don’t have a keg to stand on. In the same genre, ie chocolate bar. You can’t have anything sounds like the original or spelt like the original.

    If you spelt it Careless Whisper surely Cadburys couldnt object, as they spell it Wispa??

      Someone has kindly forwarded a bit of legal stuff for me this afternoon. Wispa is trademarked. Trademarks infringement is anything sounding like it or being spelt like it. At least I know where I stand now.

      I’ve actually come up with an name now. Which is a good thing because this is such a brilliant idea though. The best play on words/sounds ever.

      The one problem with the name and miss spelling like I might have done, is that it also can’t sound like the original. Which as good as this is, if Cadbury’s really wanted to get at me, this would fit that category. I might keep it for the truffle though!



  7. Good luck with the name, Dave. Hope you find the perfect solution. The samples you have photographed are absolutely gorgeous, I really can’t wait to try one. The Salted caramel, dark chocolate mousse and a secret ingredient sounds like my favourite. Although I’d also like a small sample of the ruby chocolate!

      I think the ruby one sounds the most boring on paper, but it is really cool. Think I’m now going to spend the rest of my days making these things.
